Nebraska Bankers H it Special Bill
N O FFICIAL statement from
the Nebraska Bankers A ssocia­
tion strongly opposes a banking bill
presented by Governor Robert Ker­
rey to the special session he called
for the state legislature August 16,
and especially hits hard at the meth­
od being used to try to force a vote
on the issue “ without benefit o f a
public hearing before the appropri­
ate legislative com m ittee.”
The bill itself, as noted in last
week’s Newsletter, would let the di­
rector o f banking take possession of
a failing state-chartered financial in­
stitution and then sell it to an out-ofstate financial institution if one can­
not be found within Nebraska.
The $75 m illion deposit Common­
wealth Savings Co. o f Lincoln folded
nearly a year ago, leaving depositors
with practically no recourse, be­
cause the state insurance fund set
up for industrial banks in 1977 had
only accumulated about $2 million
to date. Recently, State Security
Savings Co. o f Lincoln filed for
Chapter 11 bankruptcy before the
director o f banking could determine
if it was insolvent. It was reported in
the Nebraska press that one o f State
Security’s officers, Bill W right, is a
business associate and advisor o f
Gov. Kerrey.

session followed, to discuss the bail­

out “ banking” bill and to look at reevaluation o f farm land for tax pur­
poses. When the legislators con­
vened August 16, the legislature’s
executive board by-passed the com ­
m ittee structure, where public hear­
ings could be held on the bill, and
sent the controversial interstate
banking issue directly to the floor.
Sen. John DeCamp, who led the
passage o f the 1983 bill authorizing
multi-bank holding companies in Ne­
braska, and who had called a several
state conference that year with
other officials to discuss the poten­
tial for interstate banking, delivered
a blistering attack on the executive
board for its action which by-passed
his com m ittee. However, the com ­
m ittee vote o f 6-2 sent the bill to the
floor. Sen. DeCamp then pursued a
legislative rule on the floor that per­
m its a single senator to ask that the
bill be sent back to the reference
com m ittee and be assigned to a com ­
mittee. The Speaker upheld Sen.
DeCamp and sent LB3 to the refer­
ence com m ittee, which assigned it to
the banking com m ittee. Sen. De­
Camp and his seven com m ittee
members were to hold a hearing to­
day (Aug. 27) in the Capitol from
noon to 3 p.m.

change Bank & Trust Co., said “ The
legislation deserves to be aired fully
according to the rules o f the Nebras­
ka Unicameral and not forced down
the throats o f the Senators.”
“ The bill hadn’t even been printed
for interested parties to see before
the Executive Board m oved it to
general file,” Mr. H ove said. He
added, “ If all it takes is a simple ma­
jority on the Executive Board to
overstep the normal com m ittee
hearing process, the entire com m it­
tee system o f the Legislature is
threatened and the system o f legisla­
tive checks and balances is jeopar­
dized. A s the industry which would
be the m ost affected by this legisla­
tion, we deserve the right to be
heard.
“ This legislation would be detri­
mental to the econom ic future o f Ne­
braska as it would permit funds
needed in this State for agricultural
and other commercial purposes to be
siphoned o ff to the money centers
for use in other parts o f the country
or in foreign countries.”
The Nebraska Bankers Associa­
tion listed several other reasons for
opposing the legislation and the E x­
ecutive Board’s action, including:

legislation is needed, and it is m ost
certainly not needed for the con­
tinued operation o f federally-insured
financial institutions because o f pro­
cedures already in place by the

cases.
2. This is classic, special-interest
legislation designed to benefit a
small number o f firms that have not
yet qualified, for whatever reasons,
for federal deposit insurance. Such
special-interest legislation would
severely im pact the entire structure
o f Nebraska’s financial industry for
the benefit o f a few.
3. The issue o f interstate banking,
in whatever form, is very com plex.
In fact, the Congress o f the United
States hasn’t com e to terms with
the question. Nebraska, in these eco­
nom ic times, should not risk offering
itself as a testing ground for such a
far-reaching experiment.
4. Such legislation would likely be
o f little help in paying o ff the credi­
tors o f Commonwealth or State Se­
curity Savings, as no firm, dom estic
or otherwise, unless it is gambling,
is going to pay more for the assets
than they’re actually worth. The
banking laws o f Nebraska should
not be sold as a political face-saver.
5. Far-reaching laws are already

should take time to hear how others
view the issue before making a deci­
