F E D E R A L R E S E R V E BA N K O F NEW YO RK Fiscal Agent of the United States r Circular No. 5 9 1 0 ~I L December 6, 1966 J SOCIAL SECURITY BENEFIT CHECKS Payment to Survivor(s) of Joint Payees To All Banks in the Second Federal Reserve District: A t the request of the Treasury Department, we enclose a copy of the Fifth Amendment, dated November 9, 1966, to Treasury Department Circular No. 21 (Revised September 5, 1946), which contains the regulations governing the indorsement and payment of checks drawn on the Treasurer of the United States. The Fourth Amendment to the Treasury circular, sent to you with our CirĀ cular No. 5711, dated October 19, 1965, set forth a procedure for the indorseĀ ment and payment of a Social Security benefit check issued jointly to two or more individuals of the same family upon the death of one of the joint payees prior to the negotiation of the check. That procedure called for the placement on the face of the check of a stamped legend signed by an official of the Social Security Administration redesignating the survivor or survivors as the payee of the check. The enclosed Fifth Amendment provides that the legend may also be signed by an official of the Treasury Disbursing Office. Additional copies of the enclosed amendment will be furnished upon request. To all Banks and Bankers and Others Concerned: Treasury Department Circular No. 21 (Revised) dated September 5, amended, is hereby further amended by extending subparagraph (c) of paragraph k to read as follows: 19^6,as 4. Deceased payees - * * * (c) A Social Security benefit check issued jointly to two or more individuals of the same family shall, upon the death of one of the joint payees prior to the negotiation of such check, be returned to the Social Security District Office or to the Treasury Disbursing Office. Payment of the check to the surviving payee or payees may be authorized by the placement on the face of the check of a stamped legend signed by an official of the Social Security Administration or the Treasury Disbursing Office, redesignating such survivor or survivors as the payee of the check. A check bearing such stamped legend, signed as herein prescribed, may be indorsed and negotiated by the person or persons named as if such check originally had been drawn payable to such payee or payees.
