AGREEMENT, entered into this 1st day of April, 1932, between PERCY OAKES, hereinafter known as party of the first part, and WILLIAM MARTIN, hereinafter known as party of the second part, "WHEREAS, the party of the first part is producing a musical revue known as "DILLY DALLY", to open in Atlantic City on April 3d, 1932, and is desirous of obtaining additional financing to the extent of TWO Hundred and fifty ($250) Dollars, which the party of the second part wishes to furnish, NOW, THEREFORE, in consideration of the mutual covenants herein contained and the sum of one ($1. 00) Dollar each to the other in hand paid, the receipt whereof is hereby acknowledged, it is hereby AGREED: FIRST: The party of the second part shall advance the sum of Two Hundred and fifty ($250) Dollars to the party of the first part on April 1, 1932. SECOND: The party of the first part agrees to return the said Two Hundred and fifty ($250) Dollars as follows: Fifty ($50) Dollars per week on Saturday of each week until the principal sum of TWO hundred and fifty ($250) Dollars has been returned to the party of the second part. In addition, the party of the second part is to receive one quarter of one percent (1/4 of 1%) of the gross revenue received from the box office receipts to be computed at the conclusion of each week. THIRD: As further security, the party of the first part hereby assigns to the party of the second part his interest in royalties to be received from Mills Publishers Inc. who have the musical rights in the music in said revue. IN WITNESS WHEREOF, the parties hereto have hereunto set their hands end seals the day and year first above written.
