At this l a t e day, the power of the dongreSs to e s t a b l i s h a
banking system w i l l hardly he questioned.

The necessary l i m i t a t i o n or

r e s t r a i n t s and subjection of individual opinion to o f f i c i a l discretion
incidental to the establishment and present operation of the n a t i o n a l
banking system do not, in my judgment, run counter to the provisions
of the F i f t h Amendment.
A c a r e f u l study of the b i l l of Complaint leads me to the
inevitable conclusion that i t does not s t a t e f a c t s s u f f i c i e n t to
c o n s t i t u t e a cause of action.

The b i l l w i l l be dismissed.
