the President's power to reorganize the administrative agencies
of Government which I prepared for you last week I thought you
might be interested in the attached memorandum showing how and
under what circumstances various agencies were exempted in the
original bill.

Exempted under Reorganization Act of 1939.

H. R. 4425, which became the Reorganization Act of 1939,
as originally introduced and as reported out by the House Committee
excepted the following agencies:
Civil Service Commission;
Coast Guard;
Engineer Corps of the United States Army;
Federal Communications Commission;
Federal Power Commission;
Federal Trade Commission;
General Accounting Office;
Interstate Commerce Commission;
National Bituminous Goal Commission;
National Labor Relations Board;
Securities and Exchange Commission;
United States Board of Tax Appeals;
United States Employees1 Compensation Commission;
United States Maritime Commission;
United States Tariff Commission;
Veterans1 Administration.
When the bill was being debated in the House, the following
agencies were suggested for exception:
National Mediation Board - Mr. Grosser - Agreed To (D. Ohio);
National Railroad Adjustment Board - Mr. Crosser - Agreed To
(D. Ohio);
Railroad Retirement Board - Mr. Crosser - Agreed To (D. Ohio);
Rural Electrification Administration - Mr. Rankin - Rejected
(B. Miss.);
Ciril Aeronautics Authority - Mr. Randolph - Rejected (D. W. Ya.);
U, S. Baployment Service - Mr. Rogers - Rejected (R. Mass.);
Railroad Retirement Board - Mr. Van Zandt - Rejected (R. Pa.);
U. S. Forest Service - Mr. Mott - Rejected (R. Oregon).
It was suggested that the following agencies be stricken from
the list of those excepted:
National Bituminous Coal Commission - Mr. Allen - Agreed To
(D. Pa.);
Civil Service Commission - Mr. Nichols - Rejected (D. Okla.);
Coast Guard - Mr. Schafer - Rejected (R. W i s e ) ;
National Labor Relations Board - Mr. Hoffman - Rejected (R. Mich.);
U. 8. Tariff Commission - Mr. Hawks - Rejected (R. W i s e ) .

The bill was presented to the Senate and its Committee added
the following agencies to those excepted, which was agreed to by the
Senate:
Mississippi River Commission;
Federal Deposit Insurance Corporation;
Board of Governors of the Federal Reserve System.
The Committee also recommended that the following agencies
be stricken from the list of those excepted, but this suggestion was
not followed by the Senate:

U, S* Tariff Commission.
When the bill was debated in the Senate, the exception of the
following agencies was recommended:
Civil Aeronautics Authority - Mr. McCarran - Rejected (D. Nev.);
Federal Home Loan Bank Board - Mr. Taft - Rejected (R. Ohio);
Federal Sayings and Loan Insurance Corporation - M r . Taft Rejected (R. Ohio).
The Act as finally enacted April 3, 1939, excepted the following agencies:
