Revisions to Operating Circular 17
(Electronic Check Presentment Services)
DETAILS

The Federal Reserve Bank of Dallas has revised Operating Circular 17,
“Electronic Check Presentment Services,” effective February 15, 1996. The changes are
restricted to Appendices A through D, which detail each electronic check service. The
changes represent the following improvements to the services:
• The deadline to request return item pulls will be extended from 11:00 a.m.
to 1 : 0 0 p.m. on the day following electronic presentment.
• Instead of microfilm, check images may be used as the long-term storage
mechanism for truncated checks at the discretion of the Fed.
• The retention period of checks truncated at the Fed will be changed from
90 to 45 calendar days.
• The names of each service referenced in the appendices have been
changed as part of the effort to standardize Federal Reserve services
nationally.

A-1. This A p p e n d ix sets forth the te rm s o f o u r T runcation Service. The agreem ent under
w h ich this service is provided to an in stitution consists o f o u r Operating Circular 17 (Electronic
Check P resentm ent Services), including this A p p e n d ix, and the in s titu tio n 's request fo r the
service, subm itted as provided in paragraph A-15.
SERVICE DESCRIPTION
A-2. We record MICR-line in fo rm a tio n fro m an eligible item and present the item by tra n s m is ­
sion o f the MICR-line in fo rm a tio n . In addition, fo r an in stitu tio n subscribing to o u r Truncation
Service, w e w ill
(a) provide this service fo r any eligible item in a fine sort package;
(b) return an eligible item;
(c) retain an eligible item fo r at least 45 days;
(d) retain m ic ro film or im age data o f the eligible item fo r seven years, unless a longer
period o f tim e is required by state law;
(e) respond to a request fo r in fo rm a tio n w ith respect to an eligible item.

DEFINITIONS
A-3. In addition to the de fin itio n s set forth in Operating Circular 17, unless the context re­
quires otherw ise,
(a) "In stru ctio n to re tu rn " m eans a notice o f d is h o n o r or nonpaym ent.
(b) "Request fo r in fo rm a tio n " means a request that w e (i) provide additional in fo rm a tio n
w ith respect to an eligible item, (ii) tra n s m it a facsim ile co p y o f an eligible item, or (iii)
make available an eligible item or a copy thereof.
(c) "E ligible ite m " means a cash item described in the request fo r service s ubm itted as
p rovided in paragraph A-15.
CHECK COPIES
A-4. We m ic ro film or im age the fro n t and back o f each eligible item fo r w hich the Truncation
Service is provided.
RETURN OF ELIGIBLE ITEMS

o u r sole discretion, m ay extend the 1:00 p.m. deadline fo r a reasonable period o f tim e to a llo w

A-6. For purposes o f Regulations J and CC, the U n ifo rm C om m ercial Code, and o u r Operating
Circular 17, o u r receipt o f an instruction to return an eligible item constitutes return o f the item
by the institution. As a returning bank, w e w ill then return the item and, in accordance w ith our
published availability schedules, make the appropriate credit to the account m aintained or used
by the in stitu tio n fo r such purpose.
A-7. A pro p e rly subm itted instruction to return an item o f $2,500 or m ore w ill also serve as a
request fo r us to give notice o f n o n p a ym e n t to the depositary bank under Section 229.33 of
Regulation CC. For a notice o f n o n p a ym e n t to be delivered to the depositary bank by 4:00 p.m.
(local tim e fo r the depositary bank), w e m ust receive the instruction no later than 1:00 p.m. that
day.
A-8. We assume no re sponsibility fo r d e te rm in in g w h e th e r the in stitution has acted in a tim e ly
fashion w ith respect to returning an item or p ro vid in g notice o f n o n p a ym e n t to a depositary
bank.
RETENTION OF PAID ITEMS
A-9. An eligible item th a t has not been returned is retained by us fo r at least 45 calendar days
fro m the date on w hich w e first tra n s m it the MICR-line in fo rm a tio n ("re te n tio n p e rio d "). During
the retention period, we make the eligible item available to the in stitu tio n as provided herein.
The eligible item is destroyed after expiration of the retention period.
A-10. W e retain the m ic ro film or im age data o f an eligible item fo r seven years fro m the date
on w hich w e first tra n s m it the MICR-line in fo rm a tio n ("storage p e rio d "), unless a longer period
o f tim e is required by state law. During the storage period, w e make the m ic ro film or image
data available to the institution as provided herein. The m ic ro film or im age data is destroyed
after expiration o f the storage period.
A -1 1. Upon te rm in a tio n o f services under this A ppendix, we, at o u r discretion,
(a) either retain all items and m ic ro film or im age data o f items then being held fo r the

A-12. During the retention period or storage period fo r an eligible item , the in stitu tio n m ay
s u b m it a request fo r in fo rm a tio n w ith respect to the item. The request m ust contain the MICRline in fo rm a tio n th a t w e recorded fro m the item , the date w e recorded the in fo rm a tio n , and our
sequence n u m b e r fo r the item. W e w ill respond to the request by sending the item, or a fac­
sim ile or m ic ro film copy or image copy thereof, to the in stitu tio n no later than the end o f our
second banking day after the day w e receive the request. During the retention period, if we
receive a request by 10:00 a.m. on a banking day fo r us, we w ill a tte m p t to respond to the

A-13. We make available an eligible item, or a m ic ro film copy, or im age copy thereof, o n ly as
provided in the preceding paragraph or in response to the order o f a court o f c o m p e te n t ju ris ­
diction, a grand ju ry subpoena, or o th e r legal process. If w e believe th a t w e m ay be com pelled
to provide an item or a copy to other than the institution, w e shall p ro m p tly n o tify the in s titu ­
tion. It shall be the re sp o n sib ility o f the in stitution to determ ine w h e th e r the item or copy
should be produced and to assert any defense to such production. The institution is responsible
fo r the cost o f producing any item or copy, as w ell as the cost o f defending against such p ro ­
duction.
WARRANTY
A-14. We w a rra n t th a t an eligible item processed hereunder w ill be held by us in accordance
w ith this A p p e n d ix and w ill not be sent to the in stitution except as provided herein.
