The B u reau o f L a b o r S ta tistics exam in ed 1,631 m a jo r a g re e m e n ts (each
co v e rin g 1, 000 o r m o r e w o r k e r s ) fo r cla u s e s p rov id in g com pan y pay to e m p lo y e e s
engaged in v a rio u s union a c t iv it ie s .
T h ese a g re e m e n ts c o v e r e d a p p rox im a tely
7 .5 m illio n w o r k e r s (4 .7 m illio n in m anufacturing in d u strie s and 2 .8 in non­
m an u fa ctu rin g), o r a lm o st o n e -h a lf o f the estim a ted num ber o f w o r k e r s c o v e r e d
by a ll c o lle c t iv e b a rg a in in g a g r e e m e n ts in the U nited States, e x c lu s iv e of r a il­
road and a ir lin e w o r k e r s . S e v e n ty -fiv e p e rce n t o f the a g re e m e n ts e x p ire d a fter
January 1, 1959; the re m a in d e r e x p ire d during the la st h a lf o f 1958.
Slightly m o r e than tw o -fifth s o f the a g re e m e n ts studied (678), m ade p r o ­
v is io n fo r fu ll o r p a rtia l pay fo r tim e spent by som e o r a ll e m p lo y e e s r e p r e ­
senting o th e rs in g rie v a n ce c a s e s .
A n oth er 112 a g re e m e n ts stipulated that the
com pan y w ould not pay fo r tim e spent on such m a tte rs ; the re m a in d e r m ade no
m en tion o f g rie v a n ce pay.
A m on g the in d u stries in w hich g rie v a n ce pay p r o ­
v is io n s w e re m o s t p rev a len t w e re ord n a n ce, p e tro le u m and c o a l p ro d u cts, c h e m i­
c a ls , in stru m en ts and re la te d p r o d u cts, tra n sp orta tion equipm ent, co m m u n ica tio n s,
and m a c h in e r y .
P ay p r o v is io n s fo r oth er ty p es o f union a c tiv itie s w e re m uch le s s p r e v a ­
len t. C la u se s p rov id in g fo r som e fo r m o f a rb itra tio n pay a p p ea red in only ^ a g r e e ­
m en ts, o r about 1 p e r c e n t o f the tota l a g re e m e n ts studied. P ay fo r tim e spent
in a rb itra tio n p r o c e e d in g s w as e x p r e s s ly d isa llo w e d in 28 a g re e m e n ts . N egotiation
pay w as p ro v id e d in 49 a g r e e m e n ts , but 34 o th e rs p roh ib ited such pay.
P ay
p r o v is io n s fo r p a rticip a tio n on safety co m m itte e s w e re found in 66 a g re e m e n ts.
In add ition , 72 p r o v is io n s ca lle d fo r com pan y pay fo r v a rio u s oth er ty p es of
co m m itte e a c t iv it ie s .

It is im porta n t to note that th is study r e la te s only to pay p r o v is io n s
e sta b lish e d under t e r m s o f c o lle c tiv e bargain in g a g re e m e n ts and d o e s not take
into a cco u n t in fo rm a l a rra n g e m e n ts w h ere the e m p loy ee o r union re p re se n ta tiv e
is p e rm itte d to le a v e h is w o rk fo r union b u sin e ss w ithout a red u ction in pay.
The p r a c t ic e o f granting tim e o ff without lo s s o f pay w hile engaged in union
a c t iv it ie s — at le a s t th ose a c t iv it ie s w hich a re o f co n c e r n to both com pan y and
union— is undoubtedly m o r e w id e sp re a d than a study o f fo r m a l co n tra ct p r o v is io n s
w ould in d ica te .
In m any in sta n ce s, it is lik e ly that a co n tra ct p r o v is io n w as
n egotiated to defin e o r lim it an ex istin g in fo rm a l p r a c t ic e , rath er than to e s ta b ­
lis h a new p r a c t ic e .
P ay fo r G rie v a n ce P a r tic ip a tio n
P a r tic ip a tio n in g r ie v a n c e p r o c e d u r e s w as the m o st p rev a len t type of
union a c tiv ity fo r w h ich com p a n y pay w as p ro v id e d .
Of the 1,631 a g re e m e n ts
a n a ly zed in th is study, 678, o r a p p ro x im a te ly 40 p e rce n t o f the total (co v e rin g
a like p e rce n ta g e o f w o r k e r s ), contained p r o v is io n s fo r fu ll o r p a rtia l pay fo r
tim e d evoted to g rie v a n ce w o rk by a ll o r a lim ite d num ber o f e m p lo y e e s (table 1).
G rie v a n ce pay is g e n e ra lly exten ded on the th eory that the expeditiou s settlem en t
o f g r ie v a n c e s w ill w ork to the m utual advantage o f both the com pan y and the
union. A g re e m e n ts w ith g rie v a n ce pay p r o v is io n s so m e tim e s p re fa ce the g rie v a n ce
cla u se w ith a statem ent outlining the p h ilosop h y o f the p a rtie s in this re g a rd , as
the fo llo w in g cla u se fr o m one o f the co n tra cts studied illu s tr a te s :
It is m utually a g r e e d that the p rom p t adju stm en t o f g rie v a n c e s
is d e s ir a b le in the in te r e st o f sound re la tio n s betw een e m p lo y e e s
and the com p a n y . S u bject to the p r o v is io n s o f • . . /t h i s a g r e e ­

to w o rk at h is jo b at a ll tim e s , ex ce p t when p erm itted to leave
h is w o rk as h e r e in a fte r p ro v id e d .

A defin ite statem ent that the com pan y w ould not p rov id e g rie v a n ce pay
w as in clu d ed in 112 a g r e e m e n ts . P r o v is io n s o f this type u sually noted that union
