Instructions to Owner To be accepted for storage by the United States Government, the motor vehicle must be in proper running order. The procedure for registering and storing a motor vehicle is as follows: (a) The State Motor Vehicle Registration Certificate for this vehicle must be submitted at the Civil Control Station, and three copies of this form (FRB- 3) will then be prepared. (b) Two copies of this form, together with the Registration Certificate, will be handed to the evacuee for his retention until arrival at the designated Assembly Center. The third copy will be retained at the Civil Control Station. ( c) The evacuee will be given an identification tag which he will tie securely to the steering apparatus of the motor vehicle. The provisions of this paragraph do not apply: To pay on behalf of the Insured all sums which the Insured shall become obligated to pay by reason of the liability imposed upon him by law for damages because of injury to or destruction of property, including the loss of use thereof, caused by accident and arising out of the ownership, maintenance or use of the automobile. To pay for loss of or damage to the automobile, hereinafter called loss, caused (1) by fire or lightning, (2) by smoke or smudge due to a sudden, unusual and faulty operation of any fixed heating equipment serving the premises in which the automobile is stored, or (3} by the stranding, sinking, burning, collision or derailment of any conveyance in or upon which the automobile is being transported on land or on water. Use of Other Coverages A and B (2) to any Insured other than as defined in this paragraph; (3) under the conditions stated in divisions (a}, (b} and (c) of paragraph III, "Definition of <Insured'". V. General Average; Salvage Charges-Coverages C and D The Company shall also pay general average and salvage charges for which the Insured becomes legally liable in connection with transporta.~on of the automobile. VI. Loss of Use by Theft (Rental Reimbursement)Coverages C and E This provision is applicable only to private passenger automobiles not used to carry persons for a charge and not owned and held for sale by automobile dealers. The Company shall reimburse the Insured for expense, not exceeding $5 for any one day nor totaling more than $150 or the actual cash value of the automobile at time of theft, whichever is the less, necessarily incurred for taxi or livery fares or for the rental of a substitute automobile following a theft covered hereunder of the described automobile. Reimbursement is limited to such expense incurred during the term commencing seventy-two hou~s after such theft has been reported to the Company and the Police and terminating, regardless of expiration of the policy period, on the date the whereabouts of the automobile becomes known to the Insured or the Company or on such earlier date as the Company makes or tenders settlement for such theft. VII. Automatic Insurance for Newly Acquired Auto11iobiles-All Coverages If the named Insured who is the owner of the automobile acquires ownership of another automobile, such insurance as is afforded by this policy applies also to such other automobile as of the date of its delivery to him: (a} if it replaces an automobile described in this policy, and if it may be classified for the purpose of use stated in this policy, but only to the extent the insurance is applicable to the replaced automobile, and (b} if it does not replace an automobile described in this policy, and if it is used for pleasure purposes or in the business of the named Insured as stated in the declarations, and if the Company insures all automobiles owned by the named Insured at the date of such delivery, but only to the extent the insuran-:e is applicable to all such previously owned automobiles. The Company's limit of liability in respect of automatic insurance under Coverages C, D, E and F shall be the actual cash value of the newly acquired automobile. The insurance afforded by this policy terminates upon the replaced automobile at the date of such delivery. The provisions of this paragraph do not apply: ( 1) to any loss against which the named Insured has other valid and collectible insurance, or (2) unless the named Insured notifies the Company (a) as respects Coverages A and B, within ten days or (b) as respects Coverages C, D, E and F, within thirty days following the date of delivery of such other automobile, or (3} except during the policy period, but if the date of delivery of such other automobile is prior to the effective date of this policy the insurance applies as of the effective date of this policy, or (4) unless the named Insured pays any additional premium required because of the application of this in urance to such ocher automobile. VIII. Policy Period, All Coverages Territory, Purposes of Use- This policy applies only to accidents which occur and to direct and accidental losses to the property insured which are sustained during the policy period while the automobile is within the United States of America, Canada or Newfoundland, or while on a vessel between ports within said territory, and is owned, maintained and used for the purposes stated as applicable thereto in the declarations. (Attach Endorsements Here) EXCLUSIONS This policy does not apply: (a) under any of the Coverages, while the automobile is used as a public or livery conveyance, or for carrying persons for a charge, unless such use is specifically declared and described in this policy and premium charged therefor; (b) under Coverage A, to bodily injury to or death of any employee of the Insured while engaged in the business, other than domestic employment, of the Insured or while engaged in the operation, maintenance or repair of the automobile; or to any obligation for which the Insured may be held liable under any workmen's compensation law; (c) under Coverages A and B, (I) while the automobile is used for the towing of any trailer not covered by like insurance in the Company; or while any trailer covered by this policy is used with any automobile owned or hired by the named Insured and not covered by like insurance in the Company; or (2) to liability assumed by the Insured under any contract or agreement; (d) under Coverages A, B and F, while the automobile is operated (1) by any person under the minimum age required to obtain a license to operate a private passenger automobile in the state, federal district or territory, or province in which the automobile is registered or in which the accident occurs, whichever is lower, or (2) by any person under the age of fourteen years; (e) under Coverage B, to property owned by, rented to, in charge of or transported by the Insured; tinder Coverages C, D, E and F, (f) to loss due to (I) conversion, embezzlement or secretion by any person in lawful possession of the automobile under a conditional sale, mortgage, lease or similar agreement; (2) war (whether or not declared), invasion, military, naval or usurped power, civil war, insurrection, rebellion, revolution; (3) confiscation by duly constituted governmental or civil authorities; ( 4) riot or civil commotion, except with respect to Coverage C; (g) to loss of use except by theft as provided herein nor to any damage to the automobile which is due and confined to wear and tear, freezing, mechanical breakdowns or electrical breakages or failures, unless such damage follows and is the result of other loss or damage which is covered hereunder; (h) to loss of or dam<i. J\ to (I) robes, wearing apparel or other personal property or effects-c~~ted in or upon the automobile, unless specifically covered by endorsement, or (2) tires, unless damaged by fire or stolen or unless loss or damage thereto be coincident with other loss or damage which is covered hereunder, or (3) the insured property due directly or indirectly to the failure of the Insured to protect such property following damage thereto whether or not such damage is covered hereunder; (i) while the automobile is subject to any lien, mortgage or other encumbrance not specifically declared and described in this policy. CONDITIONS The following Conditions, 1 to 7 inclusive, apply to all Coverages: 1. Automobile Except where specifically stated to the contrary, the word ..automobile" wherever used in this policy shall Defined mean the motor vehicle, trailer or semi-trailer described herein; and shall include, under Coverages A and B, a trailer other than a trailer home, while used exclusively for personal, pleasure or family purposes, other than business purposes, with any private passenger automobile insured hereunder; and shall include, under Coverages C, D, E and F, its automotive equipment and also ocher equipment permanently attached thereto. When two or more automobiles are insured hereunder, whether coupled or not, the deductible provisions and other terms of this policy shall apply separately to each but as respects limits of bodily injury liability and property damage liability a motor vehicle and a trailer or trailers attached thereto shall be held to be one automobile. 2. Assistance ·a nd Cooper ation of the Insured; The Insured shall cooperate with the Company and, upon the Company's . b request, shall attend hearings and Expense Reim ursements trials and shall assist in effecting settlements, recovering the property described herein, securing and giving evidence, obtaining the attendance of witnesses and in the conduct of suits; and the Company shall reimburse the Insured for expenses, other than loss of earnings, incurred in the protection of the automobile or at the Company's request. The Insured shall not, except at his own cost, voluntarily make any paymer.rt, assume any obligation or incur any expense oth~r than. for such immediate medical and surgical relief to others as shall be imperative at the time of accident. 3. Other Insurance If the Insured has other insurance against a loss as practicable after cancellation becomes effective. The Company's check or the check of its representative mailed or delivered as aforesaid shall be a sufficient tender of any refund of premium due to the named Insured. The following Conditions, 8 to 12 inclusive, apply to Coverages A and B: 8. Financial Responsib. i aws Such insurance as is afforded by thi policy for bodily injury liability or property dama e t1ab1lity shall comply with the provisions of the motor vehicle financial responsibility law of any state or province which shall be applicable with respect to any such liability arising out of the ownership, maintenance or use of the automobile during the policy period, to the extent of the coverage and limits of liability required by such law, but in no event in excess of the limits of liability stated in t:1is policy. Such notice shall contain particulars sufficient to identify the Insured and also reasonably obtainable information respecting the time, place and circumstances of the accident, the names and addresses of the injured and of available witnesses. Assignment No assignment of interest under this policy shall bind the Company until its consent is endorsed hereon; if, however, the named Insured shall die or be adjudged bankrupt or insolvent within the policy period, this policy, unless cancelled, shall, if written notice be given to the Company within thirty days after the date of such death or adjudication, cover (a) the named Insured's legal representative as the named Insured, and (b) subject otherwise to the provisions of paragraph III, "Definition of 'Insured'", any person having proper temporary custody of the automobile as an Insured, until the appointment and qualification of such legal repre~entative, but in no event for a period of more than thirty days after the date of such death or adjudication. 7. Cancellation This policy may be cancelled by the named Insured by mailiag written notice to the Company stating when thereafter such cancellation shall be effective. This policy may be cancelled by the Company by mailin~ written notice to the named Insured at the address shown in this policy stating when not less than five days thereafter such cancellation shall be effective. The mailing of notice as aforesaid ,hall be sufficient proof of notice and the insurance under this policy shall end on the effective date and hour of cancellation stated in the notice. Delivery of such written notice either by the named Insured or by the Company shall be equivalent to mailing. If the named Insured cancels, earned premiums shall be computed in accordance with the customary short rate table. If the Company cancels, earned premiums shall be computed pro rata. Premium adjustment may be made at the time cancellation is effected and, if not then made, shall be made as soon 1 O. Notice of Accigent 11. Bankruptcy or insolvency of the Insured ot of the Insured's estate shall not relieve the Company of any of its obligations hereunder. The following Conditions, 13 to 18 inclusive, apply to Coverages C, D, E and F: 13. The Company shall have the right to return any stolen property, with compensation for resultant damage thereto, at any time before the loss is paid. When loss occurs, the Insured shall: 14. lnsured's Duties When Loss Occurs (a) protect the insured property from subse- quent loss or damage; (b) give notice thereof as soon as practicable to the Comp'.i°y or on~ of . its authorized agents and, in event of larceny, robbery or pilferage, give unmediate notice to the Police; (Continued on next page} (c) exhibit the damaged property to the Company when requested; (d) submit to examinations under oath by anyone designated by the Company, subscribe the same and produce for the Company's examination all pertinent records and sales invoices, or certified copies if originals be lost, permitting copies thereef to be made, all at such reasonable times and places as the Company shall designate; (e) file proof of loss with the Company within sixty days after the occurrence of loss, unless such time is extended in writing by the Company, in the form of a sworn statement of the Insured setting forth the interest of the Insured and of all others in the property affected, any encumbrances thereon, the actual cash value thereof at time of loss, the amount, place, time and cause of such loss, the amount of rental or other expense, reimbursement for which is provided under this policy, together with original receipts therefor, and the description and amounts of all other insurance covering such property. 15. Appraisal; Waiver If the Insured and the Company fail to agree as to the amount of loss, each shall, on the written demand of either, made within sixty days after receipt of proof of loss by the Company, select a competent and disinterested appraiser, and the appraisal shall be made at a reasonable time and place. The appraisers shall first select a competent and disinterested umpire, and failing for fifteen days to agree upon such umpire, then, on the request of the Insured or the Company, such umpire shall be selected by a judge of a court of record in the county and state in which such appraisal is pending. The appraisers shall then appraise the loss, stating separately the actual cash value at the time of loss and the amount of loss, and failing to agree shall submit their differences to the umpire. An award in writing of any two shall determine the amount of loss. The Insured and the Company shall each pay his or its chosen appraiser and shall bear equally the other expenses of the appraisal and umpire. The Company shall net be held to have waived any of the terms of this policy by any requirement, act or prooeeding on its part relating to the appraisal or to any examination provided for in this policy. 16. The procedure for registering and storing a motor vehicle is as follows: (a) The State Motor Vehicle Registration Certificate for this vehicle must be submitted at the Civil Control Station, and three copies of this form (FRB,3) will then be prepared. (b) Two copies of this form, together with the Registration Certificate, will be handed to the evacuee for his retention until arrival at the designated Assembly Center. The third copy will be retained at the Civil Control Station. (c) The evacuee will be given an identification tag which he will tie securely to the steering apparatus of the motor vehicle. ( d) On arrival at the Assembly Center the evacuee will deliver to the representative of the Federal Reserve Bank of San Francisco the two copies of this form, the Regis, tration Certificate, and the keys to the vehicle. (e) The representative of the Federal Reserve Bank of San Francisco will check all numbers on the form and if found to be correct will acknowledge receipt of the motor vehicle by signing one copy of the form and delivering it to the evacuee. If the motor vehicle described in this form is lost, damaged, or destroyed as the result of negligence while it is in the possession or custody of the United States, or any agency acting for it, the Congress of the United States will be asked to take appropriate action for the benefit of the owner.
