Pear E l m e r : Something told me that I should go to Yakima right away and register a complaint with the Federal Reserve Bank so we went over there today as it seemed a good thing to get this attended to before the matter got stale. The man in charge is Mr. Roy A. Neilan. He happened to he in Toppenish today on other business but I contacted him there. After giving him my version of the story he immediately called his chief by telephone in Seattle, repeated hthe outstanding facts in the case over long distance and the following decision was reached: That the chief in Seattle would of the Federal Reserve Bank and Assembly Center and contact you writing it down in the complete telephone to his Portland branch have a man come out to the for the purpose of getting your story, order of events as you give it to him. This testimony of yours would then be forwarded to Mr. Neilan in Yakima who would then come over to Kennewick and begin his investigation with Seely and the others involved, and if there was any evidence of unfairness in the protection of your equity, he would freeze the whole thing, which is exactly what we want' him to do. Now Elmer, this is what I said to Mr. Heilan, that according to my understanding this land had been purchased under contract by your 'father a number of years ago, that the purchase price was about $1600, that the contract had been paid down to about $800, and that you therefore had an equity in the place of about $800 which together with the unpaid balance was approximately the present value of the land. -i~l — P * That after the Government had issued an evacuation order covering this district you were approached by Mr.Seely who asked if you would sell him the 20 acre place on which you were living. His * . ... & £ l ' That you agreed to sell him the land provided he would buy the crops also, which aeely agreed to do.1 1~ t b r n O V& I' ) That you thought you were selling Seely your equity in the 20 acres, at a price to he mutually agreed upon,hjit instead Seely immediately and without your permission or consent contacted the Trustee of the Northern Pacific Land Company, said Trustee having authority to issue a deed to the 20 acres, hut who was evidently persuaded hy Seely to he unfaithful to the trust agreement‘you had with him, and he issued Seely a deed to the 20 acres without permission or consent from you, thus depriving you of your equity in the land and that a notice was then issued upon you that the 20 acres had been sold to Seely and that he was now the legal owner of the place. whereupon seely notified you he would not buy your crops hut would permit you to remain in possession of the place until such time as you might he evacuated, and allow you or your agent the same privilege to remain on the place to care for and harvest the crops up to November 1st. of this year. I went on to relate how afterwards, on the evening of the day when it was necessary for you to en-train, Seely had notified your agent John N.Davies of Kennewick, Washington that no occupancy of the house or yard would he permitted without the payment of $15 per month r e n t , that irrigation charges for balance of the year would he $120 and that he also wanted $25 additional to cover some hack taxes on the land. I claimed it was necessary for the proper care and harvesting of the crops that I live on the place and that these demands on the part of Seely were unfair and did not protect your ownership of the crops. I said you wished to have the v/hole unscrupulous deal set aside hy order of the Federal Reserve Bank in whom is invested authority of the United 'States Government and that proper protection he given to your just equity or else that you he allowed to pay up the balance you were owing to the Northern Pacific Land Company and a deed to the 20 acres issued to you. Be sure Elmer, to give this man who will call on you the name and address of the Trustee who gave the deed to Seely, and let me know; also who this w a s . I believe you had better let this man know that you are able and ready to pay up the balance that was due the Northern Pacific Land Company, if permitted to do so. Please write and let me know immediately what you have done in connection with this case.
