I shall appreciate it if you will turn the following
information over to the Custodian of Alien Property or whoever
may be the proper authority to handle this case:
The above named individual has been engaged in business
in Lakeview, Oregon, for a number of years.
On August 24, 1920,
K.
Kawaji and H. Uyento Durohased the Lake County Steam Laundry.
On March 27, 1923, K. Kawaji purchased from H. Uyento his interest
in the above steam laundry.
K. Kawaji is an enemy alien, being
a citizen of Japan.
It is reported that he is a former officer
in the Japanese Navy.
About the last part of 1940 or the first
part of 1941 he left Lakeview advising people there that he was
returning to Japan for a visit.
It is believed by people in
Lakeview that he may be serving in the Japanese Navy at the
present time.
He still retains title to the Laundry in Lakeview
but has entered into a contract to sell a 1/2 interest in it.
In investigating his income tax liability for the year
1941, it was discovered that K. Kawaji has had a trading account
with the KASAI S33CURITI^S CO., 2100 Pine Street, San Francisco,
California. This investigation disclosed that previously he had
owned stock in ^ransamerica Corporation, and it may be that he
still owns some of this stock or other securities.
It is my opinion that all property and rights to property
belonging to Japanese Enemy Aliens should be seized.
The residents
of Lakeview are anxious to get the Japs out of that place and it
looks to me as if the property could be seized and thus accomplish
that end.

Deputy Collector, W. J. Owsley, Klamath Falls,
Oregon, regarding the affairs of

individual.

$898.98 delinquent income tax, penalty and interest
against the above named taxpayer for the year 1941.

Mr. Shanks:
It is my understanding that the Oregon Alien
Property law was passed during the month of August 1920,
and became effective 60 days after t h e signing of the law
by the Governor.
It is my understanding that this law
also contains a penalty clause providing that in case
any alien shall acquire property in violation of this
law that said property shall escheat to the State of
Oregon.

Kawaji and R. Uyento purchased the Lake County
Steam Laundry on August 21, 1920, prior to the date that"
this law became effective;
however, on March 27, 1923,
K. Kawaji purchased from H. Uyento all his right, title
and interest In this business (a 1/2 interest).
It
would seem to me that according to the above mentioned
Oregon Alien Law that this 1/2 interest purchased in 1923
would actually belong to the State of Oregon.

Dear Mr. Kawakami:
So far as it is possible for us to do so we
shall answer tho questions listed in your letter of
March 19, 1942 in the order in which they appear.
(a) We haw no information as to when
evacuation w ill bo ordered from m ilitary area No. 1
nor are we sure that such evacuation w ill be ordered.
The only suggestion we can make now is that you have a
definite plan in mind looking towards the disposal or
the taking car of your property in case such an order
i3 issued.
(b) The usual legal rights of the mortgage
holder are not abridged by the evacuation order* there­
for© the rig t to foreclose is not affected. However,
if such a contingency should arise and it ib impossible
for you to arrive at a settlement with tie debt holder
which w ill enable you to continue your equity in the
property, we w ill do a ll in our power to assist you in
working out a reasonable and equitable settlerrsnt
either by trying to obtain an extension of time from
the mortgage holder or assisting in obtaining for you
the reasonable value for your equity in the property#
(c) In case the rsortgage on your real property
is foreclosed and the property is then sold for an m ount
insufficient to pay the balance owing,under certain con­
ditions the holder of the debt could levy against farm
implements, furniture, and other personal property for the
amount of the deficiency. Should th is eventuality occur
perhaps we can a ssist you in arriving at an equitable
settlement#

(d) There is nothing in the array order requiring
evacuation to indicate that special treatment w ill be given
in case a draftee has an interest in the property, '/e under—
stand, however, that th e s is a measure of protection offered
for such property by Federal legislation recently enacted end
refer you to the United tates Attorney’s o ffice, Portland,
Oregon for details*
(e) If an evacuee or anyone else gives a po?/er of
attorney to another person, the terms of the instrument w ill
be the controlling factor as to the extent of the power so
granted. If the instrument gives the attorney the necessary
power then losses occasioned through the operation of the
property would f a ll on the evacuee or other signer of the
instrument.

Dear Mrs. Kayano:
Reference is made to your recent letter about refrigerator
and other equipment being purchased on the partial payment plan.
None of the information which has been supplied to us so far
indicates that a governmental agency w ill be authorized to make
payments on such equipment during the evacuation period, 'e
strongly urge therefore that you make every endeavor to arrange
such problems in a way which w ill protect your equity. Possibly
you may be able to make temporary arrangements with someone in
your vicin ity to make the payments for the use of the refrigerator
until you can determine whether or not the refrigerator w ill be
needed by you after you have moved. This is merely a suggestion
and any arrangements which you care to make which w ill give you
adequate protection w ill meet with our approval.
We fu lly expect storage fa c ilitie s w ill be made available
to store household furniture and other items of equipment pro­
perly boxed and crated, of course, but definite details in this
regard are not yet available.
It would not seem advisable to dispose of the household
furniture unless you wish to and can obtain a reasonable price
for i t f since we have no doubt that definite details for storage
w ill be available prior to the evacuation date.
We hope you w ill feel entirely free to ca ll upon us for
assistance in any matters pertaining to the evacuation i f you
feel that our service can be helpful to you.

MEMORANDUM

Mr. George Kido of Route 4, Box 1281, City, called at this office
regarding an account held by G ill Seed Company in the amount of $128.
:.r. Kido states that the G ill Company are threatening su it. He also
states that this balance was owing by his father who passed away in 1934. The
original amount of this b ill was §200 and since the death of the father George
Kido has reduced th is amount to §128. He states that he is not sure that this
debt was owing by the father. He also states that he is now 27 years old.
Referring this to Mr. Crouch, he suggested that I contact G ill Seed
Company for their side of tne story. I spoke to Mr. G ill who informed me that
th is account was put in tne name of the son about three years before the father
passed away. Tne boy has since been purchasing seed and materials from them
and has kept his account in reasonably good shape, meanwhile making the reduc­
tion on the old account. He states that since the father died, the boy has
purchased his own place. Mr. G ill informed that he offered George Kido §85
for a cabbage planter but George Kido refused to se ll to him saying he had
promised this cabbage planter to another party.
Our final advice to George Kido was to see Mr* G ill personally and
ma~tce arrangements for the settlement of the account, suggesting that if he were
unable to pay th is, he should give M r. G ill a note if he fe lt that he owed
the account or as a second fay of settlin g this he might offer Mr. G ill a
sum of cash, the amount of whicn to be determined between themselves. Wa also
suggested that he keep his credit good for future use.

Receipt is acknowledged of your letter of April 11, 1942.
In view of the varied in u iries and also of the fact that the super­
vision is divided among several agencies, it occurred to us that solutions to
your problems might more easily be found if you were to ca ll at the local office
of the artime C ivil Control Administration, 317 S. . 6th Avenue, Portland,
Oregon.
In order to assist you^acause you intimated you had been unable to
get a permit to travel, we have obtained for you and enclose herewith a travel
permit, permitting you to come to the artirae C ivil Control Administration offices
in Portland. This authorization is subject to a ll military regulations and
restrictions and it does not permit you to travel during the curfew hours which
are after 8 p*m* and before 6 a.m.
Because the daytime train service between Portland and Medford is very
unsatisfactory involving use of the bus, you w ill probably wish to make the trip
by automobile. If you w ill notice, the permit is void after April 20, 1942 so
that you w ill have to use it immediately if you wish to avail yourself of its
privileges.
The particular function of the Federal Reserve Bank in this program is
in connection with the storage of household goods and in assisting evacuees in
disposing of their business or property. Someone on our sta ff w ill be pleased to
discuss these angles with you and representatives of other agencies w ill, we are
sure, be available to go into the other matters about which you inquire in your
letter .
It is just possible that while you are here you may be able to make some
arrangement for you to act in your professional capacity at the assembly or reception centers.

Dear Sirs
Reference is made to your letter of April 7,1942* I wish to
thank you for your courtesy and the informations contained in your
letter have clarified many things to us*

I will greatly appreciate clarification of the following
informations, since, it has been very difficult to obtain any explana­
tion from local authorities;
a*My wife is of the white race and my son is naturally a "hybrid*
My wife is of the opinion that since she has never been well due to
a post rheumatic condition(rheumatic heart disease)it may be better for
her and our son to reside near Hillsboro,Oregon at a home of her
relative for the duration. This will mean family separation but it may
be best from standpoint of social adjustments.1 would like to ask you
if this arrangement will be contrary to regulations?
b.
Reference second paragraph of your lettertyou stated tha
"beddings and linens(not mattress) will be permitted".Does that mean
that pillows(4; two for wife,one each for son and myself)will be
furnished?Are the beds provided to married couple, double-bed type?
If not, it will mean that each member will need four blankets and one
comforter(as my experience in the GGG and Army shows).Also we have fodnd '
that It takes two large trunks to provide enough containers for clothes
for the members of our family(3)alone.In your letter you said"The size
and number of packages undoubtedly will be limited to that which can
be carried by the individual or family group".Does that mean that
I can take only enough things able to b e carried by myself alone(my
wife is an invalid and my son is only 6 yrs of age).Surely one must
take along adequate clothing to protect one from disease,environmentsi
conditions and undue hardships? What type of clothes will be the best
to take?Am I to become a laborer? Is my wife to wear clothes supplied
by the Government?
c. I have a property( a lot) 75 x 113 ft located on the corner
of N.E.36 and Skidmore.lt Is assessed as $470.00 by the City of Portland.How do I go about disposing of it? I also have a almost new,
1941 Buick Special DeLuxe Sedanet(Cedar Greo^(less than 10,000 mileage)
With radio etc.,Will the Bank help me to dispose of it? Or will I
need It in my professional work?
d. My office furniture has to be disposed of.How will I
obtain permission to go to Portland? I have tried to obtain a permit
for that purpose but has been unsuccessful.
e. How do I go about requesting transportation for my
furniture here and In Portland for storage at your storage depot?
f. My life insurance will become due on June 6,1942 for the
amount of $217.19.Since this evacuation procedure for the convenience
of the Government have shut off my income, is there any way of

preventing the loss of my life insurance for the duration? This also
applies to insurance on my wife and my son.
Anything you can do to lessen the hardships brought about by
the War Department 'orders of evacuations” of citizens of Japanese
Ancestry, will be highly appreciated. We are anxiously awaiting your
reply and the reply from the Federal Security Agency.

'.Valter Fawbush informs me that he has offered $61^00 for the Oana
Bros, ranch at b’illow Flat, and asks my opinion.
This is a hard question, as, first of all, our assessments on land
are high (considered to be 67% rather than 50% of actual value)
and seemed because of the distressing values placed by the Federal
Land Bank, conciliators for the Frazier Lampke set up, etc.
The State Tax Commission had a very competent appraiser here for a
couple of months last year, but he could not come to any satisfactory
figure on values.
Some have one idea, some another. Truth is that Hood River Valley
is more like a suburban, than a rural area, and few people care to
sell except as a last resort.
I am starting my twelfth year as assessor, and during several of
those years most people were ready to sell out, but were just too
heavily involved to do so.

Koida

December 12, 194.1

William Koida, Route 11, Box 851, Milwaukie, Oregon,
called at this office today and stated that the business "Joe
Koida, F lorist” at the above address formerly belonged to Joe
Koida, that Joe Koida le ft in 1935 for Japan and has been
there since that time, that he no longer has any interest in
the business but requested that i t be continued to be carried
on in his name.
William Koida, who is a nephew of Joe Koida, attempted
to deposit five checks totaling $129.4-7 in the First State Bank
of Milwaukie (Oregon) in the account ”Joe Koida, F lorist”. This
is the name of the account used by William Koida. The Milwaukie
bank refused to accept the deposit on the grounds that the inter­
est of a national of Japan is involved and also because the checks
are payable personally to Joe Koida. In discussing the account
by telephone with the First State Bank of Milwaukie, we were in­
formed that William Koida has been sending Joe Koida in Japan
$25 pei* month, which is the lim it allowed under the previous gen­
eral license.
The writer gave William Koida a set of application
clanks (form TFE-1) and suggested that he apply for a general
licen se. The checks were returned to William Koida.
It is the writer's opinion, after discussing this ac­
count with William Koida and with the First State Bank of Mil­
waukie, that there is considerable likelihood that Joe Koida, a
national of Japan, s t i l l has a substantial interest in the firm
and possibly owns a ll of i t . It is believed that this business
should be investigated.

longing to Japanese. At Bekine* request 1 have re-written para­
graph V. and added several provisions that the warehouse company
feels Trust be inserted in the contract. These provisions appear
in every warehouse contract for the purpose of defining and
limiting the liability of the warehouseman.

FEDERAL RESERVE BANK OF SAN FRANCISCO, Portland Branch (acting as
a fisca l agent of the United States of America), hereinafter referred to as

IN CONSIDERATION of the mutual covenants and agreements hereinafter
contained,

The warehouse company agrees that it will at all times
accept,

etore and warehouse any articles delivered by the bank

to it for storage and warehousing in said space, and render such
service in & good and workmanlike manner and in accordance with
recognized standards of good warehousing for articles of the
kind so delivered to it;

and will place all articles

constituting a given lot thereof so that all articles of one
lot will be contiguous and of convenient access from time to
time, and will mark or letter the same with such distinguishing
marks or letters as the bank may from time to time direct, and
when received will issue to the bank receipts therefor prepared
by the bank and containing such descriptive numbers or letters or
combinations thereof as the bank shall require.

of any claim or demand of the owners of the goods and the bank
will defend the warehouse company in any and all suite and
actions which may be instituted against the warehouse company

It is agreed that the bank shall have on demand the exclusive
use of an additional area of 10,000 square feet of floor space in said
warehouse, to be selected and used by it for the same purposes and under
the same conditions herein provided for the use of the said 40,000 square
feet; provided, however, that i f the bank elects to exercise the right
to additional floor space, the monthly payments hereinabove stipulated
shall be increased to vl»500 per month.

The warehouse company hereby agrees that it w ill provide and furnish
such labor as may be required to receive a ll articles of the bank delivered
to the warehouse for storage therein, and place and properly store them
within the area set apart for the exclusive use of the bank in said warehouse,
and when said articles or any part thereof are withdrawn from the warehouse
by the bank, to provide and furnish such labor as may be required to move
said articles sc withdrawn from the area in which they are warehoused and
stored to such ground floor door in said warehouse at a point where they
may be conveniently placed for delivery to the bank; and the bank agrees
to pay the warehouse company for such services in addition to the amounts
hereinabove provided, at the rate of Cl*50 per man hour for such labor;
provided, however, that if the present union labor scale for said services
shall be increased or decreased during the term of this contract, said basic
rate of Clo50 per man hour shall be adjusted accordingly; and provided further,
that the warehouse company shall at a ll times receive, in addition to said
basic rate of vl*50 per man hour, such additional amounts as the warehouse
company shall be required to pay for overtime, i f any, in accordance with
the union labor scale prevailing when such overtime services are rendered.
Claims for said labor services as aforesaid shall be presented to the bank
and in form satisfactory to the bank, within thirty (30) days after such
labor services are rendered, and shall be payable by the bank within thirty
(30) days after the same are received by it .

The warehouse company agrees that it w ill at all times accept,

Instructions to O w ner
To be accepted for storage by the United States Government, the
motor vehicle must be in proper running order.
The procedure for registering and storing a motor vehicle is as follows:
(a) The State Motor Vehicle Registration Certificate for this
vehicle must be submitted at the Civil Control Station,
and three copies of this form (FRB'3) will then be prepared.
(b) Two copies of this form, together with the Registration
Certificate, will be handed to the evacuee for his retention
until arrival at the designated Assembly Center. The third
copy will be retained at the Civil Control Station.
(c) The evacuee will be given an identification tag which he
will tie securely to the steering apparatus of the motor
vehicle.
(d) On arrival at the Assembly Center the evacuee will
deliver to the representative of the Federal Reserve Bank
of San Francisco the two copies of this form, the Registration Certificate, and the keys to the vehicle.
(e) The representative of the Federal Reserve Bank of San
Francisco will check all numbers on the form and if found
to be correct will acknowledge receipt of the motor vehicle
by signing one copy of the form and delivering it to the
evacuee.
If the motor vehicle described in this form is lost, damaged, or destroyed
as the result of negligence while it is in the possession or custody of the
United States, or any agency acting for it, the Congress of the United
States will be asked to take appropriate action for the benefit of the
owner.

VI.
It is agreed that the bank shall have the right to designate agents
and representatives to be present on the premises during any time when
articles or goods of the bank are being delivered to and initially stored
by the warehouse company, and when any articles or goodfe of the bank warehoused
therein are being withdrawn therefrom, and that said agent or representative
shall have access to any part of the warehouse building wherein the articles
or goods of the bank being so delivered or withdrawn then are.

VII.
It is further agreed that the bank may terminate this agreement
at any time upon giving ninety (90) days’ written notice to the warehouse
company of its intention so to do.
VIII.

Wherever the words ’’articles of the bank’’ or "goods of the bank" are
used herein, they shall mean and include all articles and goods delivered by
the bank to the warehouse company for warehousing and storing hereunder,
and irrespective of whether or not the bank has any right, title, lien or interest
therein or holds possession of the same under custodian agreement or otherwise.
