matters pertaining to the evacuation of J penese aliens
and others of Japanese descent, we suggest that you check
all properties coming under your supervision which are
occupied by Japanese, either as renters, lessors or owners.
Proper disposition should be nado of their
businesses prior to the final evacuation order being issued.
In many instances, these arrangements will involve
considerable detail and take time to settle. This office
stands ready to assist in any way we can in ordor to avoid
the many complications that will develop should abandonment
be forced on the evacuee, due to time and lack of foresight.

June 4, 1942 *
Burnside Restaurant, 405 West Burnside Street, Portland, Oregon.
The first information we had regarding this restaurant was on March 31st,
when the owner’s son Tom Toyota called at our office in regard to his personal
affairs as well as the business affairs of his father Frank Toyota. On April 18th
our representative called at 405 West Burnside Street and was advised by the owner
Frank Toyota that he would sell the business for $6,000 explaining that his original
cost of fixtures etc., was $15,000. They were paying $125 rent on a month to month
basis to Commonwealth, Inc., managers of the property. Wong On, the Chinese prop­
rietor of Hung Far Low, 325 N. W. 4th Avenue has been interested in the purchase of
this restaurant for some time, and at about the time of our first interview was
bidding ♦ 1 ,000 for it. On account of the low figure and the prejudice that existed
between the Japanese owner and the Chinaman, no sale could be consummated. Toyota,
at about this time, dropped his price to $5,000.
The restaurant was closed for business on May 3. During a call made on
that date I found them taking inventory. I advised them the time was extremely
short but if they were not successful in disposing of their business, we would
store the fixtures without charge to them. The following day, the owner in coE3 >any
with his son and Thomas E. Lilies, a business friend and proprietor of the Sunshine
Dairy, called at this office. Toyota had appointed Lilies as his agent giving him
power of attorney to dispose of the business and the keys to the premises. We were
advised at this time that ownership of the business stood in the name of another
son Minor Toyota who is in the Array. During the course of the conversation they
indicated that they would take $4,500 for the business. On May 6 th Maillard
Holbrook of Commonwealth, Inc., in company with Wong On called at our office and the
Chinaman at that time expressed a willingness to pay something in excess of $1,000
for the restaurant. The following day he raised his bid to $1,500 and Holbrook,
during the course of a telephone conversation, advised that he thought the Chinaman
could be increased to $2,000. On May 9th, Commonwealth mailed to the owner at the
Assembly Center a 30 day vacation notice to the effect that they must vacate the
premises on or before June 9th and a copy of this notice posted on the door of the
premises. On May 11th, Wong On increased his bid to $2,000 basing his figure on
the fact that replacement of the equipment could be made by that sum. On May 13th
Commonwealth, Inc. advised us that they had accepted from Won On a deposit on the
lease and had commited themselves to him on occupancy on or before June 9th whether
or not he purchased the fixtures. The following day, May 14th, Jeffry Holbrook of
Commonwealth, Inc., visited our office making an offer of $2,500 cash for the
restaurant which was in turn transmitted to Toyota by telephone who countered with
an offer of $3,500 which Commonwealth did not accept. On May 18th I interviewed
the owner and his son at the Assembly Center discussing price and the need for
immediate sale and made the statement to him that our offer of storage could not
be held open much longer.
On May 29th Commonwealth agreed to waive a $25 clean-up charge on the
premises and also' a rent which would be due from June 1 to June 9 amounting to
approximately $37.50 in the event that Toyota would accept $2,000 cash for the
business. This information was put in letter form and attached to it was a
Cashier’s Check for $2,000 payable to the Federal Reserve Bank. This exhibit
was suggested by Commonwealth and also only to be used as an evidence of their
good faith and willingness to buy at this figure. On June 1st in company with
Lilies I interviewed the owner and his son at the Assembly Center. Lilies made
the bid of $2,000 as being final; the letter and Cashier’s Check were exhibited
and Toyota agreed to sell at this figure. The check was returned to Commonwealth
the following day. After taking some sort of inventory Lilies agreed to contact
Wong On and have the necessary papers drawn by his attorney John Darnis and close
the deal.

On June 4th L.
Schmitt attorney, Terminal Sales Building (Be 0021)
called at our office to give us the following information. It seems that a
building on the corner of 5th and Flanders occupied by the Center Hotel and owned
by his client Mrs. Candace Hartness, 1825 N. E. Clackamas Street (Ga 2958) was
leased to G. H. Luey who in turn subleased it to Frank Toyota. On November 26,
1934 Toyota was forcibly evicted from the building and judgment was rendered to
Luey for cost of such eviction. On the same date a second judgment was rendered
for #5,625 plus 6$ interest for back rent to Luey by Toyota. On April 19, 1935,
judgment of #198.50 plus 6# interest was rendered against Toyota in favor of
Mrs. Hartness for malicious destruction of property. Mir. Schmitt understood
Toyota’s restaurant was about to be sold and was asking ways and means of collect­
ing on these judgments. We referred him to John Damis who is handling the matter.
We further advised him that we had been informed that the property did not stand
in Frank Toyota’s name but in the name of his son Minor. Schmitt is also attorney

r'he first information we had regarding this restaurant was on March 31st,
when the owner’s son Tom Toyota called at our office in regard to his personal
affairs as well as the business affairs of his father Frank Toyota, On April 18th
our representative called at 405 est Burnside Street and was advised by the owner
Frank Toyota that he would sell the business for *6,000 explaining that his original
cost of fixtures etc., was $15,000. They were paying $125 rent on a month to month
basis to Commonwealth, Inc., managers of the property*
,Tong On, the Chinese prop­
rietor of Hung Far Low, 325 K. • 4th Avenue has been interested in the purchase of
this restaurant for some tine, and at about the time of our first interview m s
bidding $1,000 for it. On account of the low figure and the prejudice that existed
between the Japanese owner and the Chinaman, nosale could be consummated. Toyota,
at about this time, dropped his price to 5,000.
The restaurant was closed for business on May 3. During a call made on
that date I found them taking inventory. I advised them the time was extremely
short but if they were not successful in disposing of their business, we would
store the fixtures without charge to them. The following day, the owner in cormany
with his son and Thomas L. Lilies, a business friend and proprietor of the funshine
Dairy, called at this office. Toyota had appointed lilies as his agent giving him
power of attorney to dispose of the business and the keys to the promises* ^e were
advised at this time that ownership of the business stood in the name of another
son Timor Toyota who is in the Army. During the course cf the conversation they
indicated that they would take ;:4,5Q0 for the business. On May 6 th Laillard
Holbrook of Commonwealth, Inc., in company with *fonp On called at our office and the
Chinaman at that time expressed a willingness to pay something in excess of $1,000
for the restaurant. The following day he raised his bid to 1,500 and olbrook,
during the course of a telephone conversation, advised that he thought the Chinaman
could be increased to $2,000. On P'ay 9th, Commonwealth mailed to the armor at the
Assembly Center a 30 day vacation notice to the effect that they must vacate the
premises on or before Tune 9th and a copy of this notice posted on the door of the
premises. On May 11th, ong On increased his bid to (2,000 basing his figure on
the fact that replacement of the equipment could be made by that sum. On May 13th
Commonwealth, Inc. advised us that they had accepted from r on On a deposit on the
lease and had coramited theiaselves to him on occupancy on or before June 9th whether
or not he purchased the fixtures. The following day, May 14th, Jeffry Holbrook of
Commonwealth, Inc., visited our office making an offer of $2,500 cash for the

in c on ne c t i o n with au to mobiles and other motor vehicles
stored b y ev acuees under the terms of Public Procla ma tio n
No. 1 issued by Lieutenant General De Witt*
We wish to c on fir m to you that we will m a i n t a i n a guard at
the above pa rki ng lot co n t i nu o u s ly from 6 : 0 0 o.m. Saturday,
Ma y 2, 1942 until further notified.
A single guard will be
used until we are advised that a larger number of guards
will be re quired.
All guards used will be equipped with
side-arms, whistles, and police clubs.
We will also c on fir m to you that our charge will not exceed
8 5 ^ per hour per guard under present c o nd it io ns .
Should
conditions, b e y o n d our control in the future, make it im­
possible for us to furnish guards at this rate, sufficient
and s a t i s f a c t o r y notice will be gi ven you co nc er n in g any
con te mpl at ed increase in the guard rate per hour.
At the
present time there is no indi ca tio n that this rate m a y not
co ntinue indefinitely.
