Since March 22, 1933 > we have been forwarding
to you each week supplements to our "List of Banks in
the Twelfth Federal Reserve District Licensed to Resume
Banking Operations.”
As the primary purpose of the printed l i s t ,
and weekly supplements thereto, was to provide current
information during the period in which banks were being
re-opened in su bstan tial numbers, i t i s f e l t that due to
the comparatively few banks remaining unlicensed in th is
d i s t r i c t , the d istrib u tio n of supplements may be discon­
tinued a t th is time.

Therefore, no supplements w ill be

issued subsequent to Supplement No. U, dated June 7* 1933>
enclosed with th is l e t t e r .

regulations relating, to foreign exchange transactions a$&
"balances.
If you carry accounts in any foreign country, or
carry, on your "books, accounts owned outside the United States
please inform us and we shall immediately forward to you the
necessary forms for making reports.
Drawings made through the facilities of other
hanks in the United States need not he reported to the Federal
Reserve Bank of San Francisco hy the drawing hank, hut should
he reported hy the hank extending the facility.
Each hank is requested to transmit promptly to
the Federal Reserve Bank of San Francisco, at San Francisco«
California, the names and addresses of.all of its customers
whose transactions are known to fall within-tha scope.of the
circular, in order that necessaryinstruetions may he sent
them.

IN FOREIGN EXCHANGE

To Banks, Bankers, Trust Companies, and Others Concerned in
the Twelfth Federal Reserve District.

Section 2 of the Act of March 9, 1933, entitled “An Act to provide relief in the existing
national emergency in banking, and for other purposes”, amended subdivision (b) of Sec­
tion 5 of the Act of October 6,1917 (40 Stat. L. 411), as amended, to read as follows:
“(b) During time of war or during any other period of national emergency de­
clared by the President, the President may, through any agency that he may desig­
nate, or otherwise, investigate, regulate, or prohibit, under such rules and regulations
as he may prescribe, by means of licenses or otherwise, any transactions in foreign
exchange, transfers of credit between or payments by banking institutions as defined
by the President, and export, hoarding, melting, or earmarking of gold or silver coin
or bullion or currency, by any person within the United States or any place subject to
the jurisdiction thereof; ana the President may require any person engaged in any
transaction referred to in this subdivision to furnish under oath, complete informa­
tion relative thereto, including the production of any books of account, contracts,
letters or other papers, in connection therewith in the custody or control of such
person, either before or after such transaction is completed. Whoever wilfully vio­
lates any of the provisions of this subdivision or of any license, order, rule or regula­
tion issued thereunder, shall, upon conviction, be fined not more than $10,000, or, if
a natural person, may be imprisoned for not more than ten years, or both; and any
officer, director, or agent of any corporation who knowingly participates in such
violation may be punished by a like fine, imprisonment or both. As used in this sub­
division the term ‘person’ means an individual, partnership, association, or cor­
poration.”
The Executive Order of the President, dated March 10, 1933, issued under the authority
of the foregoing Act reads in part as follows:
“Until further order, no individual, partnership, association, or corporation, in­
cluding any banking institution, shall export or otherwise remove or permit to be
withdrawn from the United States or any place subject to the jurisdiction thereof
any gold coin, gold bullion, or gold certificates, except in accordance with regulations
prescribed by or under license issued by the Secretary of the Treasury.
“No permission to any banking institution to perform any banking functions shall
authorize such institution to pay out any gold coin, gold bullion or gold certificates
except as authorized by the Secretary of the Treasury, nor to allow withdrawal of any
currency for hoarding, nor to engage in any transaction in foreign exchange except
such as may be undertaken for legitimate and normal business requirements, for
reasonable traveling and other personal requirements, and for the fulfillment of
contracts entered into prior to March 6, 1933.
“Eveiy Federal Reserve Bank is authorized and instructed to keep itself currently
informed as to transactions in foreign exchange entered into or consummated within
its district and shall report to the Secretary of the Treasury all transactions in foreign
exchange which are prohibited.”

— the term “ dealer in foreign exchange” means any person engaged prim arily or incidentally
in the business
(1) o f buying, selling or dealing in foreign exchange, or
(2) o f buying, selling or dealing in securities for or through foreign correspondents, or
(3) any person w ho carries accounts or securities with or for foreign correspondents.
— the term “ foreign exchange” means checks, drafts, bills o f exchange, cable transfers, or any
form o f negotiable or assignable instrument, or order used
(a) to transfer credit or to order the payment o f funds in any foreign country, or
(b) to transfer credit or to order the payment o f funds within the United States for foreign
account.
— the word “ foreigners” means all those who, whatever their nationality, are physically outside
the United States. Thus, for example, foreign branches o f American banks should be regarded
precisely as i f they were separate foreign banks.

The Executive Order of March 10, 1933, prohibits all transactions in foreign exchange
except such transactions as m a y be undertaken
(a) for legitimate and normal business requirements,
(b) for reasonable traveling and other personal requirements, and
(c) for the fulfillment of contracts entered into prior to March 6,1933.
In order that the Federal Reserve Bank of San Francisco m a y keep itself currently in­
formed as to transactions in foreign exchange entered into or consummated within the
Twelfth Federal Reserve District and m a y report to the Secretary of the Treasury all
transactions in foreign exchange which are prohibited, the Federal Reserve Bank of San
Francisco hereby requires dealers in foreign exchange doing business in the Twelfth
Federal Reserve District
(1) to obtain from each person to w h o m they sell foreign exchange directly or indi­
rectly (and retain for future reference if required) a written declaration signed
by such person describing the purpose for which the foreign exchange is pur­
chased and certifying that the transaction in no w a y contravenes the Act of
March 9, 1933, the Executive Order of March 10, 1933, or any regulation issued
thereunder,
and (2) to file with the Federal Reserve Bank of San Francisco written reports which
will show the foreign exchange position of such dealers at any given time. For
the present such reports are required only from dealers who carry their own
accounts abroad and/or who carry accounts here on their books for foreigners.
Forms on which reports m a y be m a d e will be supplied upon request.
The Executive Order of March 10, 1933, permits foreign exchange transactions for the
fulfillment of contracts entered into prior to March 6, 1933. To enable the Federal Reserve
Bank of San Francisco to examine such contracts each dealer in foreign exchange doing
business in the Twelfth Federal Reserve District is directed to forward to the Federal
Reserve Bank of San Francisco a detailed list of all foreign exchange contracts entered into
by him prior to March 6, 1933, for the delivery of foreign exchange after that date. This
list should classify contracts by currencies and should show the maturity of each contract.
The dealers should advise the Federal Reserve Bank of San Francisco in writing as such
contracts are fulfilled.
If any dealer in foreign exchange in the Twelfth Federal Reserve District is in doubt as
to whether a particular transaction comes within the terms of the Act of March 9, 1933, the
Executive Order of March 10, 1933, and the regulations issued thereunder, such dealer
should submit the question to the Federal Reserve Bank of San Francisco.
All inquiries, reports, etc., should be submitted to the Federal Reserve Bank of San
Francisco at San Francisco, California.

requested as complete a list as could be obtained, of names and
addresses of all persons who have withdrawn gold or gold certificates
from banks in this district, and who have not redeposited such gold
or gold certificates in a bank on or before March 13, 1933.
The Federal Reserve Board has now informed us that the
list to be prepared and forwarded should include the names and
addresses of all persons who have withdrawn gold or gold certifi­
cates from banks in this district, and who have not redeposited
in a bank on or before March 17, 1933.
In accordance with this request, please list only those
names of persons who have not redeposited on or before March 17,
1933 any gold or gold certificates withdrawn from your bank. If
you have already submitted your list we shall appreciate your infor­
ming us immediately after March 17, of the names to be eliminated.

GOLD COIN AND GOLD CERTIFICATES

To Banks, Bankers, and Trust Companies of the
Twelfth Federal Reserve District.

Dear Sirs:
During the present emergency and until further advised, the
Federal Reserve Bank of San Francisco will absorb all transportation
charges on shipments of gold coin or gold certificates to the Bank at
San Francisco or any of its Branches, and shipping Oharges on currency
other than gold certificates from the Federal Reserve Bank of San
Francisco, if desired in exchange therefor.

For the present, abrasion

charges on gold coin will also be absorbed by this bank,, and settlement
will be made for face value of coin received, deduction being made
only for counterfeits or coins artificially abraded.
Gold coin should be shipped by express, charges collect; and
gold certificates should be forwarded by registered mail iasured.

We are in receipt of a request from the Federal Reserve
Board, Washington, D, C., that
we prepare and forward to the Board as soon as
possible after March 13, 1933, as complete a
list as can be-made from information we are able
to obtain of names and addresses of all persons
who have withdrawn gold or gold certificates from
this bank or a member bank in this district since
February 1, 1933, and who have not redeposited it
in a bank on or before March 13, 1933 and that
wherever possible we obtain similar information of
transactions prior to February 1, 1933 and that

we request the same information from nonmember banks.
In furnishing this information, please segregate with­
drawals which were made before February 1, 1933, and those after
February 1, 1933#
