I recommend that we. raise Miss Weston', salary during August and September to 4217 per month. getting $150 per month. She is now She would be very useful to us during these months in helping to close one or two studies with which she is now thoroughly familiar, and I should hate to lose her services at this particular time. Gentlemen: Receipt is acknowledged of your letter of the 26,' with reference to the expenses incurred in obtaining information on failed banks and the changes in banks by states in this district. When I wrote you that we expected only a nominal cost for obtaining information with respect to failed banks in Virginia, I felt reasonably certain that the information could be gotten by correspondence from the various county seats where the receivers filed their reports. This was attempted without success and it was necessary for Mr. Ritchie, one of the Virginia State Sank Examiners, to visit almost every county seat in counties where state bank failures had occurred. He had to travel from one end of the state to the other, and, in our opinion, the charge of $507.64 is considerably less than it would have cost us to gather the information which was obtained by Mr. Ritchie. In the case of South Carolina we found the examiner had greatly underestimated the cost of obtaining information needed to fill up the schedules on failed banks, and for this reason we agreed to give him $750, for the job for which he originally intended we should pay him $500. Mr. Fant, the State Bank Examiner, told W. Hoxton and me that it actually cost the State Department around $1,000, but that the information was worth something to his department and that he would be satisfied with $750. Sixty of these schedules show nothing as to what disposition was made of the bank after closing. Of the 67 banks which are now in process of lirluidation the schedules on those which failed prior to 1927 (15 banks) do not report either claims or payments. Very few of the schedules give any information as to assessments after suspension and practically none record the assessments prior to suspension. Generally speaking the North Carolina schedules are far from satisfactory. South Carolina The following 2uotation from Mr. Fry's letter of January 26, 1931, relative to the South Carolina suspension schedules probably explains the high expense of their preparation. "The State Department of South Carolina has gone to a tremendous expense in order to obtain the information as renorted. The Chief Examiner estimates that the examiner doing this work travelled about 4,500 miles in order to get the information he has gotten from receivers of suspended banks." The 226 schedulrs as submitted are in reasonably satisfactory condition. Virginia / The 56 suspension schedules from Virginia are in good condition, but unless unusual difficulties were encountered in preparing them, it would seem that 1,:r. One gro,„ consists of 225 national banks which suspended during 1929 and 1930, and we requested in each case the last call report prior to failure, Miss 'aeston understands about the kind of tebulations to be made with these reports and can proceed with the compilations when they come over. The other group consists of 800 nntional banks which were in existence on November 15, 1920, but have since suspended. Vie nsked for these 800 banks the call report of November 15, 1920. The data which we want to take from these reports when they come over is the same as that shown on pages 36-38 of Volume I of the Comptroller's report for 1920. This material shoolu be ooapiled by states as well as by size of bank, size of community, etc. Smead understands the type of analysis which i have in mind here. If these reports came over in my absence, maybe you can make arrangements to proceed with the tabulations. In consideration of the fact that no extra charge is made for light, excepting as aforesaid, or for heat, the said party of the first part shall not be liable for any failure to supply the same not due to gross negligence on his part. And it is agreed by and between the parties hereto, that if during the term of this lease the building is so injured by fire or other casualty, not caused by the negligence of the said puff... hereto of the second part, that the demised premises are rendered totally unfit for occupancy, and can not be repaired within sixty days from time of such injury, then this lease shall cease and determine from date of such injury. Since this will be an expense to all of the banks, it seems to me it would be more advisable to distribute it this year than to carry it over into next year, but before taking any steps in the matter would like to have your views about it. If it is decided to distribute it this year, my suggestion would be that we have a statement of the expenses prepared for submission to the chairmen of the committees early in December, say including expenses up to November 50, after which the banks could be advised as to their prorata shares. Dear Mr. Hammond: Your letter of August 23 is received enclosing copy of Mr. McClure's letter regarding the bearing of the expense of the preparation of reports covering suspended banks. I have dictated an acknowl- edgment to Mr. McClure which would be what I would send him. It says a little more than yours in some respects, and less in others, but it is noncommittal, and I should think in the circumstances would be the best way of handling the matter since it defers a final decision until there shall have been a meeting of the committee. The committee will, of course, need to give consideration to this matter, but my present thought is that by the time the committee gets around to consider it we shall have heard from all of the banks as to their views, and will also have some idea of the total cost and how it divides itself, so that we will be in a better position to determine whether a reimbursement to all banks which incur an expense with an assessment against them prorata as to size, will represent any better treatment of the expense than to let each bank pay for the expense which may be incurred in its district. MC CLUJ?: Your letter of August 20 is received advising that you have requested the Oklahoma Bank Commissioner to proceed with the work of preparing the reports covering suspended state banks in Oklahoma. In the last paragraph of your letter you have asked whether the several reserve banks would be expected to assume the cost of this work, or whether the committee would reimburse the banks. It had, I think, been the original thought of the committee thayince its work was being done as an expense of the system as a whole, tempt each reserve bank would assume such part of the cost as might result from work to be done in its district; but if this results in placing an unequal burden upon the reserve banks, the committee would no doubt ”ndp, -trIke te make such an adjustment as would distribute the cost eouitably. On the afternoon of Thrusday, August 14th, Mr. Rounds not having called yet in reply to my letter to him of the thirteenth, I called him to talk about the question of expenses for lookillg up the records of suspended banks. He agreed that we should go ahead and authorize these expenditures and othors as well, with the stipulation that we should, if possible, ask the reserve banks to estimate the cost of the work. As to the question whether the System as a whole or the individual bank should bear the expense originating in the different districts, he was undecided. He felt, however, that if any of the banks insisted that the expense should be borne by the System, it would be difficult to refuse to reimburse them. Dear Mr. Rounds: Two letters opme in this afternoon on the subject of bank suspensions which I wanted to talk with you about, but inasmuch as it was so late in the afternoon I thought it would be better to write you . bout the matter and ask you to call me tomorrow after you had thought over my letter. The first letter in cuestion is from Mr. McClure at Kansas City who encloses a letter from Colimissioner Shull of oklahoma saying that they have no facilities for making out the onestionnaire on suspensions, but can get it done for us at a cost of .t2.50 a suspension. Since there have been about 276 in oklahome, this would amount to 4690.00. Mr. Heath writes from Chicago that in Indi&na the same boat and would heve to put on somebody at to 4200.00 a month which would have to be paid for Esttmating the same rite of charge as was asked by would amount to about $400.00 for Indiana. they are in from 417u.00 by the system. Oklahoma, this We have already authorised an ekpense of !i:500.00 in the case of South Carolina and of smaller amounts in the cases of one or two other states. The indications are that the work will be done without charge in Illinois, Iowa, Florida and Georgia, whioh I mention among others because they have a heavy record of suspensions. There is nothing, however, so tar to indicate that we may not be asked to pay ear the work in North Dakota, South Dakota, Nebraska, Missouri, etc. We have simply their acknowledgment of the forms for those states with no indication yet as to the commissioners' attitudes. In the letters from the St. 7,ouis and the Dallas banks, however, there are indications that difficulty is anticipated which may cost something. There also is a question, which possibly is in my own mind only, as to whether this expense will be borne by the individeal reserve banks directly affected or by the system as a whole. In accordance with your request, I have examined the proposed lease of Room 607 in the Otis Building for the use of the Committee on Bank Reserves and I have the following comments: It is noted that the parties to this lease are the Albemarle Investment Company and the Committee on Bank Reserves. Neither the Federal Reserve Board nor the Government of the United States is mentioned or involved. The Committee on Bank Reserves has no legal existence and in my opinion the individual or individuals who sign the lease on its behalf will be the only ones bound thereby. If this is satisfactory to you, however, I know of no particular objection to it. The term of the lease is said to be for one year commencing March 10, 1930 and terminating February 28, 1931. This is ambiguous in that a period of ten days less than the year is not accounted for. Nevertheless it is agreed that $540 rent in monthly installments of $45 is to be paid. It would seam to be to be advisable to clear up the point as to the payment of rent for this ten-day interval, in case this has not already been done. I note also that the rent is payable in advance. That...IOW_ will keep in operation in the said building, for the use of tenants, a steam heating apparatus during such periods as the same may be necessary between the first day of October and the fifteenth day of May in each year; and .will employ a janitor to take charge of the rooms in said building; also furnish a reasonable amount of electricity, as the said party of the first part may determine for lighting said rooms, reserving the right, however, in case the said partIle hereto of the second part, in the judgment of the said party hereto of the first part, his attorney or agent, uses the electricity in an extravagant or unreasonable manner, of requiring the said partly* of the second part to put in meters and pay for the amount used, or in default thereof, the supply to be cut off. In consideration of the fact that no extra charge is made for light, excepting as aforesaid, or for heat, the said party of the first part shall not be liable for any failure to supply the same not due to gross negligence on his part. And it is agreed by and between the parties hereto, that if during the term of this lease the building is so injured by fire or other casualty, not caused by the negligence of the said part litli hereto of the second part, that the demised premises are rendered totally unfit for occupancy, and can not be repaired within sixty days from time of such injury, then this lease shall cease and determine from date of such injury. In such case the said part AIR hereto of the second part shall pay the rent apportioned to the time of such injury, and shall immediately surrender the leased premises to the said party hereto of the first part, who shall enter upon and repossess the same. If such injury can be repaired within sixty days thereafter, the said party hereto of the first part may enter and repair, and this lease shall not be affected except that the rent shall be apportioned and suspended while such repairs are being made. PROVIDED FURTHER: That if the said party of the first part shall have given two months' written notice to be served by leaving the same on the demised premises previous to the expiration of said term, or of any subsequent term created under the provisions hereof, of his intention to change the terms and conditions of this lease, and the said par44". hereto of the second part shall hold over at the end of the then current term after such notice, the said partP1.! 111 hereto of the second part shall be considered as a tenant, under the terms, remedies and conditions of this lease, as changed and modified by said notice, for the further period of one year, and thereafter from year to year, until terminated as hereinbefore provided, with the same effect as if a new lease in such form had been executed.
