Mutual savings banks . There were 578 mutual savings banks in operation

three-fourths of these banks, according to reports received by the Board, were
operating under some form of restriction as to deposit withdrawals*

Nonmember banks, other than mutual savings.

Statistics ere not avail­

able as to the number of nonmember banks that had resumed normal banking
ope^tions on or before March 1 5 . Preliminary compilations made from data
reoorted by the Federal reserve agents, however, show that on April 12, the

first dato for which such, data are substantially complete, there were 7*392
nonmember banks, other than mutual savings, operating without restrictions
and 2,959 n°t in operation or operating under restrictions, compared with
8 *0 U3

and 2,2^5, respectively, on May 3^•

There was, therefore, a net in­

crease of 6 5 1 during the period ipril 12 to May 3 - in the number of nonmem­

ber banks operating on an unrestricted basis.
The 7,392 nonmember banks, other than mutual savings banks, -which on
April 12 were operating; on an unrestricted basis, had total deposits (on the
latest available call date) of *5,020,000,000, while the 8,0^3 nonmember
banks that were operating on an unrestricted basis on May 31 had total deposit
of $5*1F
56»000,000.

The 2,953 nonmember banks, other than mutual savings banks

which were not in orseration or were operating under restrictions on April 12
had total deposits (on the latest available cell date) of £1 ,3 2 1 , 0 0 , 0 0 ,

During the first H days of March (i.e., preceding the President’s pro­
clamation) 2H banks (all nonmembers) were reported as having suspended, with
'total deposits of $3,350*000,

During the period of the banking holiday, i.e.,

from March 6 to March 11, inclusive, 5 banks with deposits of $1.935.000 sus­
pended or were placed in liquidation or receivership, of which 2 with de­
posits of $1,3*40.000 were national banks and 3 with deposits of $595,000 were
nonmember banks.

thermore# he stated that practically no use could be Bade of such advices,

a practice to tend items drawn on par banks In other districts to the reapactlve Federal reserve beaks for collection and realttance or return . About the
only purpose each current advices served, he *aid, is to enable the Federal
reserve bank to advise a menber bank that Inquiries about a given bank, but
sudh advice the Fedaral reserve baric gives lnfora»lly and wlthoi* assuslng
any responsibility Inasmuch as the situation of a given bank m y have chained
since the reealpt of the report by the Fedaral reserve bank,

necessary for the reason th a we cannot fully depend on the Comptroller**

of^pe. as on occasion the Coaaptroller^ information as to the licensing
of a member bank is not definite* due to the fact that the Comptroller^
office is not always as promptly aware of the fulfillment of prescribed
conditions as is the Federal reserve bark, which issues the license to the
member bank under authority and on behalf of the Secretary of the Treasury.

I would much p refer, however, to have each federal reserve bank wire
currently every change in the status of banks in it s d is tr ic t, to be
followed once a month with a li s t which would include a ll such bank changes
reported to the Board. I don*t b elieve that th is would be a formidable
task for each reserve bank, in fact it would add very l i t t l e to the work
they already do either for the Board, for their own purposes, or for other
reserve banks . Accordingly, I an submit tin g two alternative drafts of a
proposed telegram to the Federal reserve banks authorizing them to discon­
tinue the printed l i s t s and supplementr thereto: One draft merely asks
them to submit to the Board, by m ail, essen tia lly the same data as are now
reported by mail with respect to member and nonmember sta te banks; the
other draft embodies my recommendation for current telegrajfcic advices to
the Board o f a ll bank changes .

as and when the bank's capital has been Increased by an issue of not less
than $500,000 preferred stock to be sold for $1 ,500,000 and as and when the
conservatorship if any has been terminated.

We were informed this morning

by the Assistant Federal reserve agent's office at Hew fork that the required
amount of stock has not as yet been sold but that a substantial amount has
been subscribed and it seems likely that the bank will open soon
The two nonmember banks were placed on a restricted basis during the
week endli^ March 29 , after having previously resumed operations on an un­
restricted basis.

“ By virtue of the authojpty j e sted in me by Section 5 (b) of the Act of October 6, 1917
(40 Stat. L. 411) as a m e n d ^ f a e Act of March 9, 1933, and by Section 4 of the said Act of
March 9, 1933, and by virtue of Ml other authority vested in me, I hereby issue the following
executive order.

“ Until further order, no individual, partnership, association, or corporation, including any
banking institution, shall export or otherwise remove or permit to be withdrawn from the United
States or any place subject to the jurisdiction thereof any gold coin, gold bullion, or gold certifi­
cates, except in accordance with regulations! prescribed by or under license issued by the Secretary
of the Treasury.
“ No permission to any banking institution to perform any banking functions shall authorize
such institution to pay out any gold coin, gold bullion or g’old certificates except as authorized by
the Secretary of the Treasury, nor to allow withdrawal of any currency for hoarding, nor to engage
in any transaction in foreign exchange except such as may be undertaken for legitimate and nor­
mal business requirements, for reasonable traveling and other personal requirements, and for the
fulfillment of contracts entered into prior to March 6, 1933.
“ Every Federal Reserve Bank is authorized and instructed to keep itself currently informed
as to transactions in foreign exchange entered into or consummated within its district and shall
report to the Secretary of the Treasury all transactions in foreign exchange which are prohibited. ’’
Subdivision B of Section 5 of the Act of October 6, 1917, as amended and Section 4 of the
Act of March 9, 1933, prescribe a penalty of a fine of not more than $10,000 and/or an imprison­
ment for not more than ten years, for violation of the terms of the said sections.

Penalties should not be assessed against a member bank for

deficiencies in reserves for period beginning March 6 and ending on date next
preceding. March 13, 1^ or 15, depending on which of these days according to
its location such bank might first have opened to perform usual banking functions
under license issued by Secimary of Treasury pursuant to the provisions of
Executive Order of the President, regardless of whether such license was actually
issued or not,

Member^banks licensed to open should maintain reserves in accordance with
usual requirements beginning with effective date of license.

For the present and until further notice a bank not licensed to open,
whether or not it is in the hands of a conservator appointed by the Comptroller
of the Currency, or in the hands of a State Official having similar authority,
*

should not be penalised for a deficiency in reserves against deposits which have
not been made available for withdrawal by depositors.

Member banks not licensed to open on one xxbxxsbji of the above days should pending
the receipt of a license to open maintain reserves on new deposits and old deposits
made available for withdeawal as follows:

Deposits received in special trust accounts pursuant to provisions of
Regulation 7 of the Secretary of the Treasury and deposits received while a bank
is in the hands of conservator appointed by Comptroller of Currency or in the
hands of a State official having similar authority are demand deposits and
subject to demand deposit reserve.

banks a circular giving most of the information suggested by you.
We did not include, as was suggested, a list of
"nonmember banks licensed to resume banking operations under restrict­
ions in addition to those applicable to all banking institutions?.
We understood that this list was to include banks licensed to
operate under special state laws and not simply those banks which
failed to receive licenses to resume operations in full but were
continuing to operate under general restrictions.

The position of

banks which might be included in such a list will be more definitely
determined in the near future and publication before such definition
might be misleading.

Board feels that every reasonable purpose would be served and a

great deal of work an&|fexpense avoided if the Federal reserve banks discontinued
wiring other Federal reserve banks names of member and nonmember banks in their
respective districts which h&jre been licensed to.reopen and discontinued wiring
Board names of nonmeniber banks reopened and, instead, each Federal reserve bank

tirould print and mail not later, than Thursday, March 16th a list, arranged alpha­
betically by States and Cities, of all member banks in its district licensed to
reopen on Monday, Tuesday and Wednesday and of all nonmember banking institutions
licensed to reopen on such days so far as information with regard to them has
been received from the respective state banking departments.

It is suggested that

each such list be prepared on paper of approximately same size and in same general

i
form as Board’s par list, indicating head office or branch zone, and that it contain a statement that it is a list of all banks which,according to advices
received, have reopened but that it does not take the place of the par list.
State bank members should be designated by an asterisk.

The Federal Reserve Board

should be furnished one hundred copies of such list and each other Federal reserve
bank with a sufficient number of copies to mail a copy to each of its member banks.
Such lists should be forwarded to Board and other reserve banks by air mail if
this will expedite delivery.

In order that the lists may be kept substantially

up to date, it is requested that for the time being supplements thereto be
prepared as of each Wednesday beginning Wednesday, March 22, and mailed on Thursday!
covering banks licensed to reopen during the week ending Wednesday, including also
any changes in preview lists*

In this connection, the Board is advised that a

number of the Federal reserve banks will forward to fcther Federal reserve banks

1.

Member Banks of the Federal Reserve System located in
each of the twelve Federal Reserve Bank cities whose
applications to reopen have been approved should be
licensed to reopen on Monday morning March 13, 1933.

2.

Member Banks of the Federal Reserve System located in
any city having an active recognized Clearing House
Association, whose applications to reopen have been
approved should be licensed to reopen on Tuesday
morning March 14, 1933.

3.

All other Member Banks of the Federal Reserve System
whose applications to reopen have been approved shall
be licensed to reopen on Wednesday morning March 15,
1933.

4.

Care must be taken in the case of banks having branches,
that the branches are not permitted to open except in
places and at times designated above.

United States, Issued on March 10, 1933.

Until further order, no individual, partnership, association, or
corporation, including any banking institution, shall export or other­
wise remove or permit to be withdrawn from the United States or any
place subject to the jurisdiction thereof any gold coin, gold bullion,
or gold certificates, except in accordance with regulations prescribed
by or under license issued by the Secretary of the Treasury*
Ho permission to any banking institution to perform any banking
functions shall authorize such institution to pay out any gold coinf
gold bullion or gold certificates except as authorized by the Secretary
of the Treasury, nor to allow withdrawal of any currency for hoarding,
nor to engage in any transaction in foreign exchange except such as
may be undertaken for legitimate and normal business requirements, for
reasonable traveling and other personal requirements, and for the
fulfillment of contracts entered into prior to March 6, 1933.
